Psycho: it is. It VERY STRONGLY is. But unfortunately our culture has denigrated into what Tomato calls a "sue happy" culture, where people sue people for anything and everything, especially in the entertainment industry, where about 80% of the lawsuits are frivolous and a good chunk of the rest are against people who are completely innocent. And the lawyers make a TON of money off of them. I actually blame part of the economic collapse on these numerous lawsuits. They have a horrible impact on our economy and create a culture of fear.
This culture of fear is what's driving Nintendo's lawyers. So much of the parody is so close to some actual content, especially music-wise, that they're so afraid the RIAA, which is the KING of frivolous lawsuits (so much that they probably make a lot of money that way), will sue them. And these lawyers are paid big bucks to most likely prevent lawsuits from happening, not get sued and go to court and say "this is why this lawsuit is total crap."
It's horrible, but it's the truth. The good news, though, is at least we know the root of the problem, so we can go about solving it. It will be VERY difficult, but we have to recruit people en masse in order for it to be effective. And these are my words, not Tomato's or anyone else's. We have to change the culture. -CSM |
