Compensation for Innocent Felons

Here's a little something I whipped up for Language Arts, tell me if you like it (opinion paper):

Compensation for Innocent Felons
By Shelby Gatlin

Mental abuse, physical abuse, torment, loss, and suffering are all conditions that wrongfully sentenced convicts have to endure without getting anything in return, and something should be done about this. Innocent felons should be compensated for spending years in prison when they didn't commit the crime. There are many reasons as to why a policy as such should be instituted in state and federal penitentiaries, including those that have previously been expressed.

Mental and emotional abuse have a large impact on whether or not this plan of action should be instated. While in prison, inmates are beaten, assualted, and verbally abused throughout their sentence. They aren't given respect and generally aren't extended love or care, which is usually essential to living. They are treated poorly, as those whom of which should be, though not those that are innocent and don't deserve it.

Guards and fellow public offenders, in most circumstances, do not care for you and do not show you companionship. Only blankness, hatred, disrespect, contempt, and disregardal is evident. Without indication of care for another being, a person loses their will to live. Just because of one false sentence, somebody could lose everything, and possibly even those left behind that actually showed a requited love.

After years of inprisonment, the convict's family, friends, and loved one eventually move on, or might even believe that the felon did such a horrible act that entitled prosectution. When the sentence is over, or they are proven not guilty (which hardly ever happens, and, that is, if they haven't died yet) a person would be so changed for the worse that being out and free wouldn't make much difference, especially not without those that they care for by their side. Also, by the time they are released, it is plausible that those special to them have already passed away. Knowing that you have lost everything is horrid, but it is better to lose than never have at all.

Sometimes those condemned to a life of agony begin such anguish at an early age, possibly even before life has truly begun. There have been many cases in which adolescents and young adults are sentenced. These include young murderers (and other such convictions that are rather inappropriate) that happened to be in the wrong place at the wrong time. These people have their whole life thrown away and oppertunities stolen from their grasp, while the real criminal is out and about, ready and able to commit more devastating crimes.

One may, at this point, wonder how forensic scientists, detectives, and police can make suck an impacting error that changes a person's life in such a destructuve manner. Sometimes, though, it isn't a total accident. Every now and again, usually during interrogation, the interrogater can become so immensly frustrated, or they might want to just close the case and put the public at ease so badly that they feel they must resort to more primative action; violence. They'll beat them down, or even mentally torment them for hours on end until the person being interrogated is pressured just enough to let slip some false information that can be used to prosecute them to full extent. Once something is said, it is caught on tape and ends with the worst word one could hear; "guily". After that final word is announced, there is usually no going back.

There was a case in which a man named Wilton Dedge was sentenced twenty-two years for commiting a horrible act. The evidence that was used against him was identification. The victim told detectives that the perpetrator was over six feet tall, was very muscular, and had long, blonde hair. Dedge did indeed have long blonde hair, however he was slim and was less than five and a half feet tall. A hair found at the crime scene was confirmed to belong to the criminal, and DNA results showed that it did, in fact, NOT belong to Dedge. Wilton also had no prior convictions to this case. Once he was finally let out, Dedge was only left in the dust to fend for himself for the most part. Does that seem fair to you?

Every year, more than 10,000 people are wrongfully convicted. Patrick Waller was amongst those people. He spent 16 years in prison after being sentenced for robbery and kidnapping in 1992. He could have been freed seven years prior to the time he was, except the district attorney at that time objected to Waller's request for DNA testing, delaying it until Autumn, 2008. Around the same time, the actual perpetrators confessed, but the statute of limitations had expired and they can't be prosecuted. Patrick also had two children who, because of this, grew up without a father. Waller said "Sixteen years of my life taken. It's been a struggle-going to bed, knowing I'm someplace I don't deserve to be." If the attorney had agreed to the testing, Waller could have been set free and the men that commited the crime could've been sent where they belong.

As hard as it is to believe, compensation for innocen felons can end in more treachery. It can potentially calls loopholes in the judicial system, allowing a greater number of true criminals be released. If a bill was created which qualified innocent convints for retification, the government would ensure that nobody was wrongfully convicted as to keep from giving immense amounts of money and services. This could lead to prosecuters skipping over evidence that could be used to rightfully convict somebody, and letting them go to ensure not possibly giving anything up in the future (yes, I am insinuating that the government is made up of greedy, money-lusting snobs). If enough wrong-doers were set free, more people could be hurt than those put in prison for no reason. Even though this might be so, however, the chances of this happening are slim and thise rightfully let out should still be helped by the government to at least attempt to get back on their feet.

Innocent felons should be compensated for spending years in prison when they didn't commit the crime. After all the years of agony one must go through, including abuse and loss, one would deserve special treatment to try to heal the person's inner wounds, whether the attempts be futile or not. This is why there will be compensation.

Huh.

Nice paper.

I'm not sure about the compensation, because people would be standing outside of a police station to be wrongfully convicted and then ask for money.

If you give people an inch, they'll take a mile. It's why people get life insurance of family members they plan to kill, even if it's almost like a smoking gun. Money is the bait of all evil.

Still, prison is not a good place to be, and I guess a form of compensation would be best, but not too much that it can be abusable, or not worth keeping around.
