Nintendo owns the Kongs. Rare merely developed games about the Kongs. Rare could, conceivably, make more Donkey Kong games, but it wouldn't be on the XBox360--think GBA/DS. Microsoft doesn't stop Rare from developing GBA/DS titles, because the GBA/DS aren't in direct competition with any of Microsoft's products. (Not yet, anyhow.)

Long story short: Donkey Kong and the Rare-created DK characters are currently full property of Nintendo.

WOW!!! A whole new Banjo?!!! Wish I had a 360, but I'm more of a Nintendo loyalist. But still... BANJO!!!!!!!!!!!!

Yeah, shame on me for not racing out and buying some poxy handheld platformer because I was playing 'Halo' and 'Disgaea'. Don't know what I was thinking of.
