Honestly, when hasn't anyone seen mostly naked people running around in an MMORPG. I can remember when I used to play Ultima, I'd see people running around in their underwear pretty much everyday.

The lawsuit filed in the Southern District of New York on Wednesday is seeking class-action status for purchasers of the games. A Take-Two Interactive spokesman didn't immediately have a comment on Wednesday.

The plaintiff, Florence Cohen, claims in her lawsuit that she purchased the game for her teenage grandson in or about late 2004 when the game was rated "M" for mature by the Entertainment Software Ratings Board and was damaged when it came to light that sexually explicit scenes believed to be inaccessible by players were left in the game by developers.

A Dutch programmer cracked the code that locked players out of the explicit scenes and has distributed software on the Internet that allows players to access that content. The game's rating has since been changed to adults only.

The lawsuit makes claims of unfair business practices, consumer deception and false advertising against Take-Two Interactive and Rockstar Games.

The ratings change has prompted several large retailers, including Best Buy Co., Wal-Mart Stores Inc., Circuit City Stores Inc. and Target Corp., to remove the game from their shelves.

Take-Two has stopped making the game and expects to introduce a new version without that content.

On Tuesday, Take-Two Interactive announced that the Federal Trade Commission's Division of Advertising Practices is conducting an inquiry into advertising claims made for the game.

Killing off modding altogether would suck, but companies who fear mods damaging them this much are wise to do so, no matter who gets pissed at them. Very few games depend on mods so heavily for their sales that it's worth the risk.

If I were going to sue anyone, it would be the ESRB, for rating the game improperly. And they didn't, really, even considering the newly found "content" that requires hacking of the software to unlock.

Well, I don't know what rating it is for you guys arcoss the pond, but for us over here. It's an Eighteen, which is the highest you can get.

The thing is, with GameShark, it can't create graphics, an engine, yada yada yada, it can only change variables, like amount of lives, amount of health, or wheter or not you get to see the sex scene. It's just as much Rockstar's and Take Two's fault as the modder's.
