| Senior Member Join Date: Jul 2001 Location: Planet Draco Gender: Posts: 6,038 Thanks: 67 Thanked 36 Times in 29 Posts | actually it is legal if you already own the game. like say you owned a physical copy of Chrono Trigger for the SNES, it would be perfectly legal to download the ROM of Chrono Trigger. however if you were to download that same ROM file, but did not pay for the actual game then it would be illegal to own the ROM for more than 24 hours. so as long as you own a physical copy of a game then it would be okay to downlad the roms of your game collection. I however do have certain restrictions that I have placed on myself as far as emulation goes. 1. I only have emulators of defunct systems that they don't make games for anymore (NES, SNES, Genesis, master system, gb/gba, N64, etc.) 2. I only download ROM files of games I own permanently, for games I don't own I download a ROM for a 24hour time period and play through it to see if it warrents buying for my systems and if it does then I'll go out and buy it at a retro gaming store that still sells those kinds of games. and don't get me wrong it's convenient to have the roms on your comp but nothing beats the experience of playing the game on the actual console, and I still play my old systems alot, and they are still working in perfect condition (except the NES, it still needs regular cleaning sessions to keep it running smoothly) 3.ROM hacks, like total conversions to create a new gaming experience or level edits or text edits are legal as long as the original credits and copyrights are still in-tact. it is not legal, however, to completely remove any evidence of the original staff and copyrights. for example, when you boot up a super metroid rom with a hack patched to it and it says "nintendo @1993" as well as "rom hack made by soandso @ 2004" then it is perfectly legal. and I refuse to download any romhack that does not credit the original creators. (I know kargath will argue with me on that last point but I honestly don't care, I asked my town's judge and three different lawyers (my lawyer, my dad's lawyer and my friend's lawyer) about that and fanworks and they all said that as long as it was non-profit and as long as credit was givin to the original creators then there was not a problem with plagerism/copyright infringement unless the creator himself gave a cease and desist order) |
