Gender: Posts: 10,748 Thanks: 1,000 Thanked 683 Times in 464 Posts | Say goodbye to any hopes of Earthbound on the Virtual Console STARMEN.NET - EarthBound on Virtual Console In short, it has nothing to do with fan support - Nintendo probably gets our picture now (aka they know EB will be immensely popular and profitable) - but it has to do with NoA's lawyers with their heads up their asses thinking with all the pop culture references in the game they could get sued, knowing how companies cross the line when it comes to protecting their IP and don't know what fair use is. I hate it for you guys, but that's about it. That said, I think it's pretty contemptible and spineless of Nintendo to be so afraid of lawsuits that they won't rerelease the game. Hell, it's only been out fourteen years--I'd say that, if anyone in this litigious society were going to sue Nintendo for copyright violation (or whatever the hell), it would long since have happened already. Apparently both NoA and NCL want to release EB, but the legal team won't let them. Psycho: it is. It VERY STRONGLY is. But unfortunately our culture has denigrated into what Tomato calls a "sue happy" culture, where people sue people for anything and everything, especially in the entertainment industry, where about 80% of the lawsuits are frivolous and a good chunk of the rest are against people who are completely innocent. And the lawyers make a TON of money off of them. I actually blame part of the economic collapse on these numerous lawsuits. They have a horrible impact on our economy and create a culture of fear. This culture of fear is what's driving Nintendo's lawyers. So much of the parody is so close to some actual content, especially music-wise, that they're so afraid the RIAA, which is the KING of frivolous lawsuits (so much that they probably make a lot of money that way), will sue them. And these lawyers are paid big bucks to most likely prevent lawsuits from happening, not get sued and go to court and say "this is why this lawsuit is total crap." It's horrible, but it's the truth. The good news, though, is at least we know the root of the problem, so we can go about solving it. It will be VERY difficult, but we have to recruit people en masse in order for it to be effective. And these are my words, not Tomato's or anyone else's. We have to change the culture. -CSM |
