PSN class action lawsuit filed

PSN Class Action Lawsuit Filed - G4tv.com

The Rothken law firm has filed a federal class action lawsuit against Sony on behalf of "approximately 77 million" PlayStation Network users who are unable to access the PSN.

Calling the security breach the "largest compromise of Internet security and the greatest potential for credit card fraud to ever occur in United States history," the suit accuses Sony of "breach of warranty, negligent data security, violations of consumers’ rights of privacy, failure to protect those rights, and failure and on-going refusal to timely inform consumers of unauthorized third party access to their credit card account and other nonpublic and private financial information."

According to the suit, Sony failed to maintain a proper firewall and "computer security system," "failure to properly encrypt data," "unauthorized storage and retention of data," and violation of "Payment Card Industry Data Standard(s) and rules and regulations."

Calling this a "reprehensible situation," the suit states that Sony "caused, and continues to cause, millions of consumers fear, apprehension, and damages including extra time, effort, and costs for credit monitoring, and extra time, effort, and costs associated with replacing cards and account numbers, and burden, and is harming both consumers’ and merchants’ ability to protect themselves from such fraud."

The suit categorizes the time between Sony learning of the problem and informing the public as an undue delay, saying that it prevented consumers from making informed decisions as to "whether to change credit card numbers, close the exposed accounts, check their credit reports, or take other mitigating actions."

The suit seeks both actual and punitive damages for the class. Although it doesn't name a specific amount, I think we can assume it will be at least a two crap-loads of money.

Affected parties can sign on to the case by contacting the law firm through a web form or by phone. Here's a copy of the entire complaint for you legalese fans out there.

1. It wasn't Sony's fault.
2. They took that risk (OF THE PSN SHUTTING DOWN, AND BEING UNUSABLE**) when they signed up for it. (Not trying to blame Sony, or it's users, I'm just stating a fact.)

3. What are they expecting to get out of this anyway.

**** off. It is TOTALLY sony's ****ting fault. they never encrypted our personal details, never maintained a secure system, that amongst with numerous other things violated the data protection act. Sony ****ed up, it's totally their faults.

Yeah, dude, I remember the first time my credit card information was stolen from eBay. I wanted to press charges, but you know, I took the risk.

How dare people assume their information will be secured!

I was referring more to the risk of the PSN getting shut down (in one way or another), and it's features being unusable.
Same for those with Wii's and 360's.

nobody gives a **** about psn shutting down

they care about the credit card database.

was it really hacked? i know people managed to get dev access and give themselves free psn money but until now i had heard "nope the credit database is fine"

Also trying to pass this off as not sonys fault is hilarious. the x-box and wii have been partially compromised and people have managed to get free games and ****, but no one ever managed to get into the ****ing credit card database

oh yeah and if you ever used your credit card on psn you should probably get a new one

If they had root access encryption of the credit card details is pretty much useless, but what *really* astounds me is that a company like Sony seems to be storing unhashed passwords.

Uh, whoa, really? That bad?

You know, I thought this would blow over, some minor exploit would turn up and Sony would say "oh we overreacted, have a free DLC"

PSN is free.

I don't think "I can't access CoD for 3 weeks" was the big issue here, though.

Whether or not they attempt to cover that with a "service may go down" clause, they're basically accepting money for an advertised service provided with the hardware. It's a break of faith.

Actually, "Let the buyer beware" tactics are frowned upon and discouraging to capitalistic markets. There are laws against that kind of thing. Corporations like Sony become the focus of consumer aggression toward clauses buried in legal jargon - Clauses which amount to things like "We'll provide you a service, maybe, if we can be ****ed doing it."

But the lawsuit's not even about that, it's about Sony's inability to protect financial details of which they may not even have legal license to keep record.
