I don't get why they do such high suit filings in the millions when the damages done haven't been in 5 million dollars worth. It's greedy, deceitful, and just plain stupid.

That's not excessive. I'm glad they got that, for the same reason I laugh at some of my friends that used to mod that were forced to buy new 360's.

If you're dumb enough to get the punishment in the first place, you deserve the banhammer, period. Stealing the Halo 3 Epsilon is not only illegal, but heinous in it's own right. Modding, or glitching in the Mainstream game is simply idiotic. I've gotten several people banned for it. I won't tolerate it. Custom games are different. If you want to have a glitch game of Gears, or want to mod the hell out of Halo 2, it's fine. Just keep it Custom.

/rant. Don't get me started on excessive when it's not.

Damages are designed to both compensate the alleged victim and punish the accused/serve as an example to others that such behavior will not be tolerated.

What gamers/enthusiast press aren't getting is that filing a suit doesn't mean it won't get tossed out or that it has merits. For example, AI could sue me for 6 million dollars because I'm an ******* and go through the paperwork and cost of filing such suit in the appropriate courts. It doesn't mean that the suit won't get tossed out during the first hearing.

Modding as in tampering with the system itself. Like in Halo 2, how you can fly with the Warthog or dual-wield swords. Impossible, unless you mess with the Xbox itself. Same thing with other games. I'm not totally sure why that would be otherwise construed.

Modding as in messing with the software itself is bad and can lead to cheating, so as a measure they have to ban those that mod in that way. You cannot get banned for modding as in putting new things into your xbox360 such as LED lighting, new case, etc.

This is where I point out that you need to be more specific when you use a word. Modding software is called hacking. Modding hardware to do absurd things in online videogames is unnecessary, those people were probably just using hacks. You can, for instance, put Linux on your Xbox, and run it like a regular Linux PC. You can do this entirely without modding the system. There's no reason to mod your system for OMG H4X.
